A new California mortgage modification law passed in 2008 (CA Civil Code 2823.6(b)) provides a powerful Foreclosure Defense tool our lawyers may be able to use on your behalf. - The homeowner has defaulted on payments.
- The lender will recover more under the loan modification or workout plan than through through foreclosure on a net present value basis.
- The home mortgage loan was made between January 1, 2003, and December 31, 2007.
